Is Vape Vending Profitable in Florida? The Rules First, Then the Math

- 21+
- or a lockout device the dealer controls
- 1 permit
- for each machine
- 60 days
- until a listed product is contraband
Vape machines can do well in Florida’s nightlife and smoke-shop markets, but only if you set them up the way the law requires. Get the rules right first; the money depends on it.
This guide is general information, not legal advice. Laws change. Read the current Florida Statutes chapter 569 and check with your county and city before you place a machine.
The Florida rules for nicotine vending machines
Florida’s nicotine product rules are in chapter 569 of the Florida Statutes. For vending machines, three things matter most:
- Lockout device or 21+ only. Self-service sales of nicotine products are prohibited where people under 21 can get to them. A vending machine is allowed only if it has an operational lockout device under the control of the dealer or an employee, including a mechanism that stops the machine if its power source fails and one that dispenses only one product at a time. The restriction doesn’t apply in an establishment that prohibits anyone under 21 (s. 569.37).
- A permit for every machine. Each dealer who owns, leases or operates nicotine vending machines needs a permit for each machine, posted on or near it. Several machines at one location need only one permit for that location (s. 569.32).
- The nicotine products directory. The state keeps a directory of nicotine dispensing devices found attractive to minors. Once a product has been listed for 60 days it’s contraband, and it can’t be sold or shipped in Florida (s. 569.311 and s. 569.312).
Federal rules apply too, and they’re strict about age: no sales to anyone under 21.
Why ID verification matters
The machines we sell for this market have touchscreens with age and ID verification at the machine. That supports the lockout requirement and protects the venue. Many operators still place them only in 21+ venues, where staff can see the machine, for a second layer of protection.

Where vape machines sell
The best spots are 21+ venues with late hours and steady traffic: bars, nightclubs, hookah and cigar lounges, smoke and vape shops (as an after-hours or overflow sale), and some hotels. The worst are anywhere minors can walk up to the machine.
What drives the money
- Venue fit. Late-night, 21+ traffic is what sells. Pick venues where people ask staff for vapes.
- Venue agreements. Most venues take a share of sales. Agree on it in writing, along with who checks IDs and who has the keys.
- Product mix and price. Stock compliant products customers ask for, priced near local shops. Live sales data shows what’s moving.
- Compliance costs. Permits, keeping up with the directory, and the time to stay compliant are part of the cost of doing business.
So, is it profitable?
It can be, in the right 21+ venues with compliant products and a clean setup. It also carries more legal responsibility than snacks or drinks, so treat compliance as the first line of your plan, not the last.
